COMPANY POLICIES
W.A.S. Properties, LLC, and Walden’s Creek, LLC are both
doing business as Supercabins.net, hereinafter
“Company”. Currently, all cabins are owned by either
W.A.S. Properties, LLC or Walden’s Creek, LLC.
The Customer shall mean the individual signing the
rental agreement. In the event the Customer is an entity
or organization, the individual making the reservation
shall also be considered the Customer in addition to the
entity or organization.
The words you, guest, and yours shall have the same
meaning as the word Customer. The word arrival or
arrivals shall have the same meaning as check-in, and
the word departure or departures shall have the same
meaning as check-out. The words we, us, and our shall
mean The Company.
All homes are privately owned and their prices are
subject to change. The Company reserves the right to set
minimum night stay requirements for certain times and
minimum and/or maximum occupancy requirements for the
properties.
SECURITY DEPOSIT:
Each property booked, is subject to a $250.00 security
deposit. The security deposit is to partially cover
damages that may occur during a stay, to cover any items
that may be stolen or become missing from the property,
or to cover any excessive cleaning that may result. In
no way is your liability limited by the security
deposit. Assuming you return the property in the same
condition that existed prior to your arrival, and
nothing is missing or stolen, you will receive the
entire security deposit back. The security deposit will
be refunded in approximately 14 days after your
departure. You agree when making a reservation that you
will be personally liable for any and all damages that
occur during your stay, including any attorney fees that
the Company may incur and you personally guarantee that
you will cover such expenses. Upon sending any form of
payment, that signifies your acceptance of all the
company policies. Do not place diapers, sanitary
napkins, or other foreign objects in the plumbing
system. In doing so, you agree to be responsible for all
damages and costs incurred by the Company.
RESERVATIONS:
All reservations are non-refundable at the time you make
payment. In the event you fail to sign your Rental
Agreement, and return a copy of your driver’s license
along with a copy of the front and back of your credit
card within 10 days after the date you made the
reservation, the Company reserves the right to cancel
your reservation and retain the amount of money you have
paid as liquidated damages. However, travel insurance is
available see the website for details. However, we will
allow you to change the reservation within 60 days of
your stay by allowing you to pay a $50 change fee and
move the reservation within one year of your stay.
Should the rates be higher when you make your change,
you agree to pay the increase. Should the rates be lower
when you make your change, we will not refund any money.
The changes must be made before your original arrival
date, and 100% of all monies are due once a change is
made. Once a reservation is changed there are no further
changes or refunds. When a reservation is made, 50% of
the entire balance including all taxes, fees, nightly
charges, etc… is due at the time of booking, and the
balance is due at least 60 days before the date of the
reservation. You must call us to pay for the balance.
All checks are deposited in the Company’s bank account
which may bear interest (the interest shall remain the
property of the Company). Any statement that you place
on your check, even though we may deposit or cash it,
does not bind us in any way. We are only bound by our
policies and terms of the Rental Agreement. Should you
make a reservation 60 days or less from the date of your
arrival, 100% of all monies are due at the time of
booking. Anything you are required to mail us is due at
our mailing address which is Post Office Box 494,
Gadsden, AL. 35902. The Company will send you a
confirmation notice by email confirming your
reservation, and charges after you make payment and sign
and return the Reservation Agreement, along with a
photocopy of your driver’s license and front and back of
your credit card. No reservations are binding on the
Company until and unless the Company sends a
confirmation notice. Sometimes properties are sold, have
unforeseen construction and repairs that must be made.
In those events, the Company shall have no liability to
the Customer except to refund in full for all charges.
However, the Company reserves the right in its
discretion to make a equal or larger cabin by bedroom
available for the same exact dates without additional
costs to the Customer, and the Customer agrees that the
Company may do this. The Company reserves the right to
refuse service to anyone or take a reservation in its
sole discretion. The rates listed are subject to change
until a confirmation notice is issued, even though a
credit card may have been charged or a Rental Agreement
has been signed.
DISPUTES:
You agree that if any dispute or legal action occurs,
that it will be governed by the State Of Alabama, and
you agree to waive any rights you may have to have the
case heard in another State. In addition, you agree that
you will pay any costs the Company incurs to collect any
monies due, or pursue relief an the account of any
damages, vandalism, or theft, including the
reimbursement of attorney fees incurred by the Company
before and during litigation.
AGE REQUIREMENTS:
We will not rent to vacationing students or singles, or
other persons under 25 years of age unless accompanied
by an adult or parent. No un-chaperoned groups.
WEATHER:
The Company will not give refunds, or credits for bad
weather. Travel insurance is available to cover this
risk. For the most recent weather information for the

ROADS:
Mountain roads can be tough at anytime. We do not
guarantee any road surface conditions. Most roads are
well maintained but are curvy and steep. Some units may
have gravel drives or roads. Maintenance of these roads
are fairly efficient but they may be bumpy at times. In
the late fall-winter-early spring it is common to have
hazardous road conditions. It is strongly recommended
that all guests have four wheel drive and/or chains.
Motorcycles and trailers may not be able to access every
home. Road conditions and maintenance or not guaranteed.
The Company does not give refunds or credits due to road
conditions. The Company suggests travel insurance to
cover these risks. You are responsible for your
transportation. The Company does not provide any type of
transportation for the guests.
MUTIPLE PARTIES SHARING PROPERTY:
Many of you will vacation with other couples, other
family members or friends, but only one the Customer
signs the rental agreement. We will hold the Customer
responsible for payment and other facets of the
Customer’s responsibilities spelled out in the lease. We
will only accept payment from one person or entity who
will be the Customer. If you are splitting a property,
please work out the splitting of costs internally as we
cannot split the costs up. Only the person signing the
reservation agreement is the person we will be sending
confirmations, key codes, and directions to, and that
person will be the Customer.
OCCUPANCY:
The maximum occupancy is stated on the website, and
assumes every sleeping unit will be occupied.
Over-occupancy is considered a serious violation of your
Rental Agreement and you will be asked to leave should
over-occupancy occur. Any guest having house parties,
found with over-occupancy, disturbing neighbors with
loud unnecessary behavior, or found with an unauthorized
pet will be evicted and or prosecuted. No refunds will
be given in the event you are evicted or asked to leave
due to a violation.
PROPERTY DESCRIPTIONS:
Every effort has been made to assure the descriptions
contained within the website are accurate. However, the
Company will not be held responsible for changes made to
the properties in furnishings or equipment or the
general condition of the property.
UTILITIES & BREAKDOWNS OF EQUIPMENT:
The Company maintains the properties well, but the
properties experience a wide variety of unexpected
breakdowns. From time to time the properties have
trouble with utilities, and other issues. The Company
will make every effort to get the utility companies and
others to respond quickly. No refunds or partial credits
will be given for equipment, utilities or other issues
that are not working properly.
LIMITATION OF COMPANY LIABILITY:
In the event the Company sells a property, the Company’s
only liability shall be to refund in full the total
reservation costs to the Customer. However, the Company
reserves the right in its discretion to offer another
similar property with equal or greater sleeping
accommodations during the same exact time as a
replacement at no additional cost to the customer.
FORMS OF PAYMENT:
The Company accepts as forms of payment a money order,
cashier’s check, certified bank check drawn on a bank,
all major credit cards, and a company or personal check
so long as it is received on or before 60 days before
the scheduled arrival date.
ACTS BEYOND CONTROL OF COMPANY:
The Company shall not be liable for events beyond their
control which may interfere with your stay, including
but not limited to Acts Of God, acts of governmental
agencies, fire, strikes, war, or inclement weather. No
refund or credit given should any of these events
interfere with you stay.
FURNISHINGS & EQUIPMENT:
Furnishings and equipment are subject to change without
notice.
CREDIT CARD AGREEMENT:
You agree corporately and personally that you: (1) are
providing your credit card number as a guarantee of
payment to Company, (2) You agree to pay all rent and
charges related to the reservation for the property, (3)
You accept all the terms of the Company policies and
Rental Agreement, and accept liability both personally
and corporately for rent and charges related to the
property reserved, as well as any damages, costs, and
expenses beyond normal wear and tear during the term of
the reservation with Company. You understand that these
costs will be charged to the Customer’s credit card. In
the absence of another payment arrangement, you
authorize the Company to charge your credit card for
payment of these items. The company may use any funds
received from you upon the Company’s receipt of the
funds.
PET POLICY:
No animals or pets of any kind or allowed in the
properties except for a possibility of a Dog on a
case-by-case basis. If a Dog is allowed, it will be
noted in the reservation agreement and a fee will be
charged accordingly. Dogs must be house trained/broken
and must not weigh over 20 pounds. No more than one dog
may occupy a property at one time. If a Dog is allowed
pursuant to the Rental Agreement, please make sure that
bathing and flea dipping are done before your arrival.
Do not leave the dog alone in the property unless it is
kept in a carrier or kennel. Please make sure the dog is
leashed when out of the property. In addition, make sure
that you clean-up the inside and outside of the property
as it relates to the Dog. The Pet Fee is a
Non-Refundable fee of $90.00 per Dog, and this fee is
not a damage deposit. In addition, an additional $100.00
security deposit will apply. In the event you have a Dog
at the Property you agree to be liable for any and all
damages, and expenses without limitation and authorize
the Company to charge your credit card such additional
monies as are necessary to compensate the Company for
the damages. If a guest has a Dog that has shed
excessively, or if the Dog leaves behind any surprises,
fleas, or damages to the property, the $100.00 security
deposit would be non-refundable and your credit card is
further subject to additional charges. In the event any
guest is found violating the rules you will be evicted
immediately, and your monies will be forfeited as
liquidated damages.
ITEMS NOT FURNISHED BY COMPANY TO PROPERTY:
The Company does not furnish the following: laundry
detergent for units with washer/dryer, shampoo,
hair-dryers, charcoal and lighter fluid for grills,
alarm clock, flashlight, salt, pepper, sugar, and other
condiments, irons, ironing boards, laundry detergent,
coffee filters, plastic wrap, foil, spices, baby cribs,
high chairs, as well as any items that are not listed
under Items Furnished By Company. You may want to bring
extra towels, and bath cloths.
ITEMS FURNISHED BY COMPANY:
The Company shall furnish 2 bath towels, 2 rolls toilet
paper, 1 hand towel, 2 small bars of soap, and 4 bath
cloths per bathroom, cooking utensils, dishes, pots,
pans, 3 trash bags in kitchen, and dish detergent.
ARRIVALS:
Permitted Arrival for guests is after 4pm E.S.T.. The
Company makes every effort to insure all properties are
clean and ready for occupancy after 4pm E.S.T. However,
during Holidays and Peak Season, arrivals could be as
late as 5pm E.S.T. Do not plan on buying groceries
before your Permitted Arrival. The Company cannot let
you in early nor can we provide refrigeration
facilities. In unusual circumstances the permitted
arrival may be delayed for reasons beyond the Company’s
control.
HOT TUBS:
The use of a hot tub may involve certain health risks.
The Company asks that persons with high blood pressure,
hypertension, heart disease, diabetes, sugar problems,
pregnant women, and children under age 16 and others
with health risks or those under care of a physician,
not use the hot tub. Hot tubs are cleaned between guest
stays. Make sure and cut the temperature down after each
use and at departure, and replace the cover after each
use and at departure. Please remember there are certain
health risks that are associated with using a hot tub.
The housekeepers drain, sanitize, refill and replenish
chemicals in all tubs prior to your arrival therefore it
may not be warm till later that evening. Hot tub covers
are for insulation purposes and are not designed to
support a person or persons. Do not stand on the hot tub
covers. In the event you break a hot tub cover, you
agree to reimburse the Company $400.00. Please shower
before using the hottub. Do not place bubbles, bath
oils, or any other foreign substance in the hot tub, or
you will be charged a minimum of $500.00 fee plus any
additional damages and costs incurred by the Company.
PESTS AND ENVIORNMENT:
To insure the best guest experience, the Company
performs regular pest control maintenance on all
properties. Because many of the properties are located
in the woods and or mountains, the Company cannot
guarantee that they will be pest free. The Company does
not offer refunds, discounts, or credits, for pests
including lady bugs. Unfortunately ladybugs are a part
of the environment and the Company is unable to prevent
them from visiting the properties.
COUPONS, DISCOUNTS, & OFFERS:
No coupon, discount, or offer, may be used in
conjunction with any other coupon, discount, or offer.
SMOKING:
The properties are non-smoking, and at no time is
smoking allowed in the property.
CARE OF PROPERTY:
You understand and agree that you are responsible for
the condition in which the property that you have rented
from the Company is left at departure. You agree that
the property will be left in the same condition found
upon check-in. If the property is not left in the same
condition found at check-in, you agree to be personally
and corporately responsible for any damage as well as
corporately if applicable. We hereby agree to personally
and corporately indemnify and hold harmless the Company,
its officers, contractors, agents, employees, members,
affiliates, subsidiaries, and owners, and principals
harmless for any injuries, deaths, damages, problems,
costs, expenses, attorney fees, issues, or disputes that
may occur as a result of making the reservation and
staying in the property. This indemnify shall survive
the termination of the reservation and the departure of
a stay indefinitely and shall become effective the
earlier to occur of: (1) making first payment or
deposit, (2) signing reservation agreement, (3) arrival,
(4) departure, or (5) making any payment including but
not limited to final payment.
HOUSEKEEPING:
The properties are cleaned after each guest. No mid-stay
cleaning is provided.
TELEPHONES:
The cabin is equipped with a telephone. All homes have
blocks for direct long distance calls. Bring your
calling card or credit card to make long-distance calls.
CONSTRUCTION:
The area is growing and constantly new construction is
occurring. There are no refunds given for construction
taking place near the property.
DEPARTURES:
Departure is no later than 11am E.S.T. There are no
exceptions to this rule. Please call our 800 number and
notify us that you have completed your Departure at
1-800-401-5106. In the event our housekeepers find that
you did not complete departure by 1115am E.S.T., you
agree to pay an additional $100 charge, plus $75 for
every hour thereafter. Before you leave, make sure you
have read and followed all instructions posted at the
cabin relating to departure, as well as do the
following:
1. remove all food from the house and place in outside
transhcans
2. secure lids on outside trash cans
3. clean and re-shelve all dishes or place in dishwasher
and begin cleaning cycle
4. clean out refrigerator and freezer
5. close and lock all windows and doors
6. place all bed sheets, towels, and mattress covers in
the floor of the nearest bathroom, DO NOT PLACE QUILTS,
OR BEDSPREADS IN THE BATHTUB.
7. Empty the trash cans in the bathrooms and place them
in the outside trashcans.
8. Turn hottub temp. down, and replace cover on hottub.
9. In the months when the airconditioning is on, please
turn the thermostat up to 80 and make sure thermostat is
in cool mode, and in auto. In the months when the heat
is on, please turn the thermostat down to 65 and make
sure thermostat is in heat mode and in auto.
10. Return all furniture and items to their original
location in the property if you moved them.
11. If you disconnected the tv, vcrs, or unplugged
something make sure to plug them back.
*** In the event the above departure items are not done;
then, you are subject to being charged a fee equal to
the greater of your security deposit or our actual costs
to place these things back to normal.
LOST AND FOUND:
The Company is not responsible for any items left behind
at the property.
WHERE DO WE PICK-UP THE KEY:
The properties do not have keys. Each property has been
installed with an electronic key pad with a set of
numbers on it. The housekeepers change the codes 7 days
before your permitted arrival, you can call the office
to request your key code. Please do not wait until your
arrival as the Company is not staffed late, and we may
be out of the office or on the other line and have to
call you back. You will use this code everytime you
re-enter the property. To lock the door simply press the
lock button when leaving the property.
MIMIMUM NIGHT STAY:
Typically, there is at least a two night minimum stay.
However, the Company may agree to a one night rental in
its discretion. Typically on dates around Holidays, the
Company likely will require longer minimum night stays.
The Company reserves the right to make changes to the
minimum night stay policy in its discretion.
MAINTENANCE ISSUES:
Please report maintenance issues to the Company and we
will call and send someone out for maintenance. In the
event you cannot reach us, please listen to the options
and it will give you numbers to call for maintenance.
The response time for maintenance is usually within 24
hours. The earlier you contact us the sooner a problem
can be looked at by the maintenance persons.
Unfortunately appliances, HVAC, refrigerators
televisions, hot tubs, utilities, and other items
sometimes malfunction. The Company cannot guarantee them
to perform properly 100% of the time. No refunds or
credits will be given for malfunctioning equipment or
utility issues.
LOCATION OF PROPERTIES & DIRECTIONS:
You assume the responsibility for finding the
properties, and refunds or discounts will not be given
if you fail to find the property. We will provide you
with directions anytime upon request within 7 days of
your arrival date. It is your responsibility to make
contact with us in advance to receive directions.
Directions can be emailed to you. It is best to call
early to receive directions to the property, as we may
be out of the office during the week-end, or during the
day of your arrival.
POWER OUTAGES:
Please bring along flashlights, drinking water, warm
clothes, and a cooler in the event of a power outage.
Power outages are more common during harsh weather which
may occur in this region of the country due to
snowstorms, ice, and other inclement weather.
PROHIBITED ACTIVITIES:
The following activities are prohibited at the
properties at all times:
1. The Storage & Use Of Fireworks
2. Playing loud music
3. Having loud parties
4. Smoking inside the property
5. Use of candles or open flames on the Property
GRILL:
Most of the properties are equipped with a grill. Do not
remove the charcoal debris after use. Our housekeepers
will dispose of that when needed.
FIREPLACE:
The fireplace if applicable is a non-vented propane gas
log fired firebox. Please do not throw any paper or
other materials including logs into the fireplace. Do
not remove or adjust the logs. There is no need to open
the damper.
CONDITION OF PROPERTY AT ARRIVAL:
If you find any items to be missing, in bad repair, or
dirty, please call The Company immediately and leave a
voice mail upon your check-in if you cannot reach anyone
at the office.
